1. Definitions
In these terms, the following definitions apply:
• VergelijkTaxi.nl — the VergelijkTaxi.nl platform, operated by Forward Tech Solutions, Vlierweg 12, 1032 LG Amsterdam, Chamber of Commerce 72966440.
• Driver — an independent taxi driver or taxi company offering rides via VergelijkTaxi.nl.
• Customer — the natural or legal person who books a ride via VergelijkTaxi.nl.
• Ride — the transport of passengers performed by the Driver from pickup to destination address.
• Platform — the website and underlying systems of VergelijkTaxi.nl.
2. Role of VergelijkTaxi.nl
VergelijkTaxi.nl is solely an intermediary platform. We connect Customers and Drivers and facilitate the formation of a transport agreement.
We are not a carrier ourselves. The transport agreement is formed directly between the Customer and the Driver. VergelijkTaxi.nl is not a party to this agreement.
We are not responsible for the execution of the Ride, including the quality of transport, safety, punctuality or the conduct of the Driver.
3. Formation of the booking
When you submit a booking request via VergelijkTaxi.nl, we forward it to one or more Drivers. As soon as a Driver accepts the request, the transport agreement between you and that Driver comes into effect.
You will receive a confirmation by email or WhatsApp with the Driver's details and the status link where you can follow the progress.
4. Prices
The price shown on VergelijkTaxi.nl is the price you pay the Driver. This price is inclusive of VAT and all foreseeable costs.
No additional costs are charged by VergelijkTaxi.nl to the Customer on top of the price shown at booking.
Unforeseen additional costs (for example toll roads not part of the route, waiting time caused by the Customer, or extra stops) may be charged by the Driver, provided they are communicated in advance.
5. Payment
Payment is made directly to the Driver after the Ride. Which payment methods are accepted (cash, card, credit card) varies per Driver and is communicated in advance.
VergelijkTaxi.nl is not a party to the payment between you and the Driver and does not collect any amounts on behalf of the Driver.
VergelijkTaxi.nl receives a commission from the Driver for facilitating the Ride via the platform. This commission is not passed on to the Customer and has no effect on the price shown at booking.
6. Cancellation
You may cancel your booking free of charge via the status link as long as the Driver has not yet started the Ride.
When the Driver is already on the way to the pickup address, you must contact the Driver directly. The Driver may in that case charge reasonable costs.
In case of a no-show (the Customer is not present at the pickup address), the Driver may charge the full ride.
7. Obligations of the Customer
The Customer is required to provide correct and complete information when booking, including pickup address, destination, pickup time and number of passengers.
The Customer must be present at the pickup address on time and behave properly towards the Driver.
The Customer is liable for damage caused by him/herself or fellow passengers to the Driver's vehicle.
8. Liability
VergelijkTaxi.nl is solely responsible for the correct functioning of the platform. We are not liable for damage arising from the execution of the Ride by the Driver.
Our liability for any damage as a result of a failure in the platform is limited to the amount paid out by our insurer in the relevant case, or, if no payment is made, to a maximum of € 500 per event.
Liability for indirect damage, including consequential damage, lost profits and missed savings, is excluded.
The limitations in this article do not apply in case of intent or gross negligence by VergelijkTaxi.nl.
9. Force majeure
In case of force majeure (for example extreme weather, strikes, outages at third parties such as telecom providers or hosting), we are not obliged to perform our obligations and are not liable for any damage.
10. Complaints
Complaints about the execution of the Ride should first be resolved directly with the Driver. If you cannot reach a resolution, contact VergelijkTaxi.nl at [email protected].
We will handle your complaint within 14 days and will mediate between you and the Driver where possible.
11. Personal data
Our privacy statement applies to the processing of personal data. You can find it on our privacy page.
12. Changes
We may amend these terms from time to time. Changes will be announced on the website at least 14 days before they take effect. For pending bookings, the terms that applied at the time of booking remain in force.
13. Governing law
Dutch law applies to these terms. Disputes will be brought before the competent court in the district of Amsterdam, unless mandatory law designates a different court.
